1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your visit to Lighthouse Cannabis (“we,” “us,” or “our”), a licensed recreational cannabis dispensary in the State of Maine, and your use of our website located at www.lighthousecannabismaine.com (the “Site”), including online menu browsing, order reservation, and any account features. By entering our premises, using the Site, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use our Site or purchase from our dispensary.

2. Eligibility — 21+ Only

You must be at least 21 years of age to purchase, possess, or consume recreational cannabis products under Maine law, and to use this Site. By using the Site or entering our dispensary, you represent and warrant that you are at least 21 years old. We require valid, government-issued photo identification before completing any sale, and we reserve the right to refuse service to anyone who cannot provide satisfactory proof of age.

3. Compliance with Maine Cannabis Law

All purchases are subject to the possession and purchase limits established under Maine’s adult-use cannabis laws and OCP regulations, which are subject to change. We reserve the right to limit the quantity of any product sold to a customer in a single transaction or day to remain compliant with applicable law. It is your responsibility to understand and comply with Maine law regarding possession, consumption, and transport of cannabis products, including that cannabis may not be transported across state lines under any circumstances, consumed in public spaces, or provided to anyone under 21.

4. Online Menu and Order-Ahead Reservations

The Site may allow you to browse our product menu and reserve items for in-store pickup. Product availability, pricing, and potency information displayed on the Site are estimates and subject to change without notice due to inventory fluctuations and state tracking requirements. An online reservation is not a completed sale; all sales are finalized in person at our licensed premises after in-person age verification and payment. We reserve the right to cancel or modify any reservation due to inventory availability, regulatory limits, or suspected fraudulent activity.

Due to restrictions on cannabis-related payment processing, online payment may not be available for cannabis products; payment is generally completed in person using accepted methods disclosed at the dispensary.

5. Prohibited Uses of the Site

You agree not to:

  • Use the Site if you are under 21 years of age.
  • Provide false information regarding your age or identity.
  • Use the Site for any unlawful purpose or to purchase cannabis for resale, distribution, or transport outside Maine.
  • Attempt to access restricted areas of the Site, interfere with its operation, or use automated means (bots, scrapers) to access or reserve products.
  • Upload harmful code or attempt to compromise the security of the Site.

6. No Medical Claims; Health and Safety Disclaimers

Our products are sold for adult recreational use only and are not intended to diagnose, treat, cure, or prevent any disease. Statements about products on the Site or in-store have not been evaluated by the U.S. Food and Drug Administration. Cannabis products may impair your ability to drive or operate machinery; effects vary by individual and product. Keep all cannabis products away from children and pets. Cannabis use during pregnancy or while breastfeeding may pose risks to a developing fetus or infant. Consult a physician before use if you have a medical condition or are taking medication. Additional required warnings appear on product packaging as mandated by OCP and DEA labeling rules.

7. Intellectual Property

All content on the Site, including text, graphics, logos, product descriptions, and design, is owned by or licensed to Lighthouse Cannabis and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

8. User Accounts

If you create an account to use order-ahead or loyalty features, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate age and identity information. We may suspend or terminate accounts that violate these Terms or applicable law.

9. Disclaimer of Warranties

THE SITE AND OUR PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT AS EXPRESSLY REQUIRED BY MAINE LAW.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LIGHTHOUSE CANNABIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Lighthouse Cannabis, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of our products, or violation of applicable law.

12. Governing Law and Federal Law Notice

These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law principles. You acknowledge that cannabis remains illegal under federal law, and nothing in these Terms or on the Site is intended to encourage the violation of any federal, state, or local law. You are solely responsible for understanding how these laws apply to you, including if you plan to travel with cannabis products, which is not permitted across state lines or on federal property.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved informally by contacting us at the information below.

14. Changes to These Terms

We may revise these Terms at any time by posting an updated version on the Site with a new effective date. Continued use of the Site or our dispensary after changes are posted constitutes acceptance of the revised Terms.
