End User License Agreement
Lighthouse Cannabis
Recreational Cannabis Dispensary, State of Maine
Effective Date: January 1st, 2026
1. Scope of This Agreement
This End User License Agreement (“Agreement”) is a legal agreement between you and Lighthouse Cannabis (“we,” “us,” or “our”) governing your access to and use of our website, online menu, order-ahead reservation system, and any related account features (collectively, the “Platform”). This Agreement does not govern the sale of physical cannabis products, which is addressed in our Terms and Conditions. By accessing or using the Platform, you agree to be bound by this Agreement. If you do not agree, do not access or use the Platform.
2. Eligibility
The Platform is intended solely for individuals who are at least 21 years of age, consistent with Maine’s adult-use cannabis laws. By using the Platform, you represent that you are at least 21 years old and legally permitted to view and reserve cannabis products in your jurisdiction. We may implement an age-gate or account verification step and may deny or revoke access to anyone who cannot confirm eligibility.
3. License Grant
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform on a personal device for your own personal, non-commercial use — specifically, to browse our product menu, manage your account, and reserve products for in-store pickup. This license does not transfer any ownership rights in the Platform to you.
4. Restrictions
You agree not to:
- Copy, modify, adapt, translate, or create derivative works of the Platform or its underlying software.
- Reverse engineer, decompile, or disassemble any part of the Platform, except to the extent such restriction is prohibited by applicable law.
- Use any automated system, bot, or scraper to access, reserve inventory through, or extract data from the Platform.
- Sublicense, rent, lease, sell, or otherwise transfer your access rights to any third party.
- Use the Platform to place reservations on behalf of, or for delivery/pickup by, anyone under 21 years of age.
- Circumvent any age-verification, security, or access-control feature of the Platform.
- Use the Platform in any way that violates Maine cannabis law, OCP regulations, or any other applicable law.
5. Account Registration
Certain Platform features require you to create an account and provide accurate information, including your name, date of birth, email address, and phone number. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.
6. Orders Are Reservations, Not Sales
Placing an order through the Platform reserves product for in-store pickup only; it does not constitute a completed sale. All sales are finalized in person at our licensed premises, subject to in-person age verification, applicable purchase limits, and product availability at the time of pickup.
7. Third-Party Services
The Platform may integrate with third-party services, such as point-of-sale, inventory management, payment, or notification providers. Your use of those services may be subject to additional third-party terms. We are not responsible for the availability, content, or practices of third-party services integrated with the Platform.
8. Intellectual Property
The Platform, including its software, design, graphics, trademarks, and content, is owned by Lighthouse Cannabis or its licensors and is protected by intellectual property laws. No rights are granted to you other than the limited license expressly set forth in Section 3.
9. Availability and Modifications
We may modify, suspend, or discontinue the Platform, or any part of it, at any time, with or without notice, including for maintenance, regulatory compliance, or inventory-system updates. We do not guarantee that the Platform will be uninterrupted, error-free, or available at all times.
10. Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE, OR THAT PRODUCT AVAILABILITY OR PRICING SHOWN ON THE PLATFORM WILL BE ACCURATE AT THE TIME OF PICKUP.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LIGHTHOUSE CANNABIS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF THIS AGREEMENT SHALL NOT EXCEED FIFTY DOLLARS ($50).
12. Termination
We may suspend or terminate your access to the Platform at any time, without notice, if we reasonably believe you have violated this Agreement, provided false age or identity information, or engaged in unlawful conduct. You may stop using the Platform and close your account at any time by contacting us.
13. Governing Law
This Agreement is governed by the laws of the State of Maine, without regard to conflict-of-law principles, and without regard to the Uniform Computer Information Transactions Act to the extent it is not otherwise mandatorily applicable.
14. Changes to This Agreement
We may update this Agreement from time to time by posting a revised version on the Platform with a new effective date. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Agreement.
